NHS Resolution has recently announced that it has implemented a new Clinical Negligence Claims Agreement for 2024.
The agreement, which has been developed in collaboration with key stakeholders, including Action against Medical Accidents (AvMA) and the Society of Clinical Injury Lawyers (SCIL), includes several key features, such as:
- Extended limitation periods for certain cases, providing flexibility for claimants and their representatives.
- Emphasis on early disclosure of relevant documentation to help narrow issues and reduce investigation costs.
- Improved communication protocols, including ongoing acceptance of electronic correspondence and service of documents.
- Encouragement of pre-action discussions and dispute resolution to avoid unnecessary litigation.
In response to the updated agreement, Sharon Allison, Chair of SCIL, says, “The agreement encourages apologies where appropriate and reflects that harmed individuals and their families often want to ensure that similar errors are avoided in the future. Defendant organisations are encouraged to provide apologies and identify where lessons have been learned and what steps have been taken to prevent further harm.”
Simon Hammon, Director of Claims Management at NHS Resolution added, “The fact the parties have been able to agree a successor agreement reflects the cultural change we have witnessed in how clinical claims are managed. It is extremely pleasing to see the continued desire to work together to remove friction from the claims management process.”

What is Medical Negligence?
Medical negligence (clinical negligence), put at its simplest, is a civil claim for failures in medical care. It occurs when someone has been harmed as a result of treatment received from a healthcare professional, including GPs, doctors, consultants in NHS hospitals, private doctors, nurses, physiotherapists or even dentists.
Healthcare professionals owe a duty of care to their patients, and if they fail to meet this duty and it causes harm or injury, then a patient could potentially be entitled to compensation because of injuries sustained that would not have been sustained but for the negligence.
