Erb’s Palsy Claims

When things don’t go right, we are here to get you the answers you deserve.

If your child suffers from Erb’s Palsy and you suspect this was caused by negligent medical care during childbirth, our specialist medical (clinical) negligence team can advise whether you have a claim.

What is Erb’s Palsy?

Erb’s Palsy (also known as Brachial Plexus Paralysis) is a medical condition that typically results from trauma during childbirth and can affect one or all of the five primary nerves that provide for movement and feeling to the shoulder, elbow, wrist and hand. Damage to the nerve, such as bruising or tearing, can in severe cases cause complete paralysis of the affected limb. Whilst some children recover independently, others suffer permanent damage requiring many years of physiotherapy intervention and/or  surgery.

Erb’s Palsy can permanently affect the mobility and function of a child’s arm, resulting in a life-long disability that impacts significantly on their daily lives.

Erb’s Palsy Compensation Claims

Birth related injuries are devastating for families. We understand the importance of supporting families through what is a difficult and daunting time. Our specialist solicitors are experienced at navigating the sensitive medical and legal issues involved in pursuing a claim against the NHS or a private medical practice. We can help families to secure compensation where there was negligent medical care from the doctor, midwife, or nurse, including in cases of:

  • Negligent care during labour
  • Incorrect use of medical equipment during the delivery of a baby
  • Excessive force being used during the delivery of a baby
  • Failure to refer the mother for caesarean section in time
  • Failure to move the baby out of a trapped position

Injuries to the mother and child during labour are sometimes unavoidable. However, in cases where injury was avoidable, medical negligence compensation can be used to cover the cost of ongoing care that may be needed or to replace financial losses suffered by families due to their child’s injuries.

Our specialist birth injury solicitors will guide you through the compensation claims process, fighting for you to receive the explanations and compensation you are entitled to.
